What Kinds Of Cases Do You Handle?

There are many different types of family court cases. While not all cases require an attorney, such as name changes, many do. Some cases are just too complex to combat alone. Having reliable legal representation before you go to court is the best practice.

Some of the cases we handle are:

  • Divorce
  • Custody disputes
  • Domestic violence
  • Visitation rights
  • Spousal/child support

Paul N. Mirabelli, Esq. has the experience you need to get the desired outcome. While you may feel that you and your partner can agree on the majority of your case, it is always best to have legal counsel.

In East Brunswick, NJ, mediation is required before obtaining a divorce. This step helps the parties reach an agreement over certain terms before the divorce is approved by a judge.

What Happens To My Assets After A Divorce?

Family Lawyer East Brunswick New Jersey

Typically, anything that was acquired during your union is shared property between you and your spouse. However, there may be circumstances in which particular property you own is deemed solely yours and vice versa.

For example, if both parties have agreed on the division of property during mediation. The preliminary divorce agreements are brought before a judge for final approval. Often, uncontested divorces in which both parties agree to an amicable split, division of property, assets and postnuptial payments have been decided.

Since New Jersey requires mediation before a final divorce decree can be granted, many issues are resolved before going to court. In this case, the court is more of a formality and a required part of the process. However, there is typically very little back-and-forth between the parties.

Who Gets Custody After Our Divorce?

There are two types of recognized custody in New Jersey:

Legal custody refers to making major decisions regarding the child. For example, where the child goes to school would fall under whichever parent has legal custody.

Physical custody is concerned with residential rights, such as where the child resides most of the time.

Each custody has its own implications. There can also be a sharing of custody, which is referred to as joint custody. If parents have joint legal custody, they both can make major decisions regarding the child. If parents have joint physical custody, the child spends nearly equal amounts of time with each parent.
